Columbia City and Fort Wayne Visitation Attorneys: Parenting Time
Decisions about who your children will live with and how often you will get to see them are among the most wrenching decisions any parent can face.
The family law attorneys of Leonard, Hammond, Thoma & Terrill, P.C., understand the depth of emotions involved in these decisions as well as the legal issues they entail. We will work diligently to help you create a parenting time arrangement that is in the best interest of the children and meets your specific goals.
Types of Custody
The decisions involved include who will receive legal custody and physical custody of the children and whether either form of custody will be awarded to one parent or to both, jointly. Legal custody involves making decisions about the child's education, medical care and religious upbringing. Physical custody is where the child will live.
Indiana's Parenting Time Guidelines include a "presumptive minimum" amount of parenting time: the minimum amount of time the state considers reasonable. These guidelines give the noncustodial parent custody of the children every other weekend and for one midweek overnight.
Tailoring a Plan to Meet Your Individual Needs
The guidelines are not appropriate for every situation. For example, if you travel for business, work nights or have an unconventional schedule, the guidelines will not work for your family. We develop a plan that makes sense for you and your children and is tailored to your family's unique circumstances.
Our lawyers will seek to negotiate or mediate a reasonable parenting time arrangement outside of court. If the other side refuses to be reasonable, you can rely on our experience and skill at trial.
